Clear commercial terms

Terms of service

These terms cover Pacyra accounts, local artwork processing, photo credits and printed canvases. They are governed by Belgian law and EU consumer protections.

1. The service

Pacyra provides browser-based tools that transform a user-provided image into geometric, block-in, painterly, projector and export guides. Results are creative aids, not guarantees of artistic, educational, therapeutic or commercial outcomes.

2. Accounts and eligibility

Official exports and purchases require a verified email-and-password account with accurate contact information. You must be at least 18 years old to create an account and to make purchases. Classroom and workshop participants do not need accounts of their own, since printed or projected guides are shared by the account holder. Users must protect access to their email and account. Organisations are responsible for authorised use by their staff and learners.

3. Your content and permissions

You retain rights in your source and locally generated work. You grant no licence to Pacyra to store or train on the photo because it is not uploaded. You must have the rights and permissions needed to use the source and export, and must not use the service to infringe rights, misrepresent provenance or break the law.

4. Photo credits

A credit unlocks a photograph. It is used when an authenticated user generates a guide from a photograph that has no active photo pass, and the server records a random pass ID with a non-reconstructive hash of the photo file, never the photograph itself. An active photo pass covers that photograph in full for its stated validity of one year: repeated generations with different settings, previews, the projector and every permitted download format, without further consumption. Five free credits are provided each week and reset every Monday at the displayed server time. Purchased credits expire one year after purchase.

A local guide cannot be verified by the server, so consumption happens when the photo pass is issued at generation. Idempotent retries and an active pass for the same photograph do not consume again.

5. Prices, taxes and withdrawal

Published prices are €2.99 for 10 credits, €4.99 for 25 credits and €14.99 for 100 credits, excluding VAT. Stripe Checkout shows the binding total, currency and applicable tax before you pay. There is no subscription and nothing renews automatically.

EU consumers normally have a 14-day right of withdrawal. For credit packs, checkout asks for your express agreement to immediate delivery and your acknowledgement that this ends the withdrawal right for the delivered credits. A printed canvas is a physical good made to order and is covered by section 6 instead of this one.

6. Printed canvases

A printed canvas is manufactured to the design you send and to no other. It is made by a printing partner outside the European Union and posted to the delivery address you give at the till. Stripe shows the binding total, the postage and the VAT before you pay, and that is the amount charged. Your original photograph is not part of the order and is never uploaded.

Delivery times are estimates and not promises. Production usually takes 2 to 7 days and the post 4 to 15 business days, and neither is within our control once a parcel has been handed over.

Every order is looked at by a person before anything is made. Where the print file will not print well at canvas size we ask you for a replacement file, which costs nothing further, and the order returns to the queue once you send it. Where we cannot make the canvas at all we cancel the order and refund it in full.

Because the canvas is made to your own design, the 14-day right of withdrawal does not apply once the order goes into production. That exemption is Article 16(c) of Directive 2011/83/EU, written into Belgian law as Article VI.53, 9° of the Code of Economic Law. Production starts when we pay the printing partner to make the canvas, and that is the moment your orders page starts saying In production. Until it says that you may still cancel and be refunded in full, and writing to support is all it takes.

None of that touches the legal guarantee of conformity. A canvas that arrives damaged, faulty, incomplete or not what was ordered is replaced or refunded, and the refund policy says how to ask.

7. Acceptable use

  • Do not attack, scrape abusively, circumvent quota enforcement or interfere with other users.
  • Do not submit illegal payment activity or fraudulent disputes.
  • Do not use exports to falsely claim that an output is an authentic work by another artist.
  • Do not upload a photo to support or attempt to place harmful code in text fields.

8. Availability and changes

Pacyra may maintain or change features, limits and provider integrations. Existing active grants retain their capability snapshot during the validity period. Reasonable notice will be given for material adverse commercial changes where required.

9. Warranties and liability

Nothing in these terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by our fault, or any liability that cannot lawfully be excluded. Statutory consumer rights, including the legal guarantee of conformity, remain unaffected. Subject to that, and because artwork is processed only on your device, our total liability for other claims is limited to the amounts you paid for the service in the 12 months before the event giving rise to the claim.

If you cause damage to Pacyra through fraud, abuse of the service, fraudulent payment disputes or other unlawful conduct in breach of these terms, you are liable for that damage and the reasonable costs of establishing and recovering it, including legal costs, to the extent permitted by applicable law.

10. Suspension and termination

Accounts may be restricted for substantiated abuse, security or payment risk. Financial audit data is not erased to conceal transactions. Users may delete their account subject to documented legal retention.

11. Governing law and contact

Pacyra is operated by Nymiva, a sole trader established in Belgium, Moorweg, Zottegem, enterprise number (KBO/BCE) 1040.644.704, VAT BE 1040.644.704, reachable at support@pacyra.com. These terms are governed by Belgian law, without limiting mandatory consumer protections of your country of residence. Raise a dispute with support@pacyra.com first. We aim to acknowledge complaints within 5 working days and answer substantively within 30 days. Belgian consumers may also contact the Consumer Mediation Service (Consumentenombudsdienst). Consumers elsewhere in the EU may contact their national consumer authority, or the European Consumer Centre in their own country for a cross-border complaint.

If a dispute is brought before a court, the losing party bears the costs of the proceedings as determined by the court under applicable procedural law, including court fees and the prevailing party’s statutory procedural cost indemnity. This applies to both parties equally and never requires a consumer to pay more than mandatory law allows.
